Work after studying in Spain turns on three legal positions, not one post-study work visa. A higher-education student can normally perform compatible employed or self-employed work for up to 30 hours a week, but Spain’s 24-month job-search residence expressly prohibits work. A graduate who qualifies can instead seek a direct modification into residence and work after completing the corresponding qualification.
Those routes solve different problems. Study status combines education with limited compatible work, job-search residence creates time to search or prepare a business project, and direct modification creates work-authorised residence. The correct comparison starts with legal status, not the word visa. It belongs inside the wider study in Spain route for Indian students because programme level affects which transition is available.
Which Spanish status lets a graduate work?
Permission changes at each stage. The consolidated Spanish immigration regulation and the Ministry’s current procedure sheets distinguish a study authorisation, residence for job search, and residence and work. Calling all three a post-study work visa conceals the point a graduate most needs to know, which is whether employment is legal on the status held that day.
| Stage | Purpose | Work position | Next legal step |
|---|---|---|---|
| Higher-education study authorisation | Complete the authorised programme | Compatible employed or self-employed work, normally up to 30 hours weekly | Complete the qualification, then select a qualifying transition |
| 24-month job-search residence | Search for suitable work or prepare a business project | No work is authorised | Apply for the corresponding work authorisation after finding the job or project |
| Direct modification admitted for processing | Move from a qualifying study status into residence and work | Provisional residence and work applies while the application is decided | Meet the employed or self-employed route’s full conditions |
| Granted residence and work | Perform the authorised employed or self-employed activity | Work under the granted route and its conditions | Register with Social Security where the employed route requires effectiveness |
The job-search route is therefore not a softer work permit. It can protect legal residence while a graduate looks for an opportunity, but a job cannot begin merely because an employer has shown interest. The graduate needs the corresponding authorisation. Direct modification is a different route with its own qualification, contract or business evidence and procedural effects.
This status test also prevents an old rule from reappearing. The current Ministry modification sheet, updated in April 2026, doesn’t impose the superseded generic condition that every applicant must first complete three years of study. Eligibility still depends on the qualifying study category, completed qualification and the requirements of the chosen work route.
Can international students work while studying in Spain?
A higher-education study authorisation automatically permits both employed and self-employed activity when it remains compatible with the studies. The national rule normally limits that activity to 30 hours per week. No separate work-authorisation application is required for this automatic permission, but the student still has to remain inside the conditions of the study authorisation.
The Ministry puts the automatic nature of the rule plainly.
La autorización de estancia de larga duración obtenida para estudios superiores autorizará a trabajar por cuenta propia y ajena, automáticamente y sin necesidad de un trámite adicional.
Spanish Ministry of Inclusion, Hoja 4 bis
| Question | Why it matters | What does not prove permission |
|---|---|---|
| Is the authorisation for higher education? | This category receives automatic employed and self-employed work permission | A generic student label on a website |
| Is the work compatible with study? | Study remains the authorised purpose | An employer’s willingness to schedule more hours |
| Does the activity remain within 30 hours weekly? | The national limit normally applies during the study route | A holiday period assumed to erase the limit |
| Does the profession have another legal requirement? | A regulated activity can require a qualification or other compliance | The study authorisation by itself |
The limit is a legal ceiling, not an income forecast. It does not promise that a role will be available, that the timetable will fit, or that earnings will cover tuition and living costs. The separate cost of studying in Spain should therefore be affordable without treating future student work as guaranteed money.
Which study routes receive automatic work permission?
The automatic rule attaches to a long-stay higher-education authorisation. A student on a Spanish master’s programme or MBA route still needs to confirm that the programme and institution support the stated higher-education authorisation. A course title alone does not determine immigration category.
Other long-stay activities are not safely treated as equivalent. Post-compulsory secondary education, training activities, language study and specialised healthcare training can sit under distinct rules. Some may have work possibilities under their own conditions, but the higher-education automatic statement should not be copied to every student or trainee.
A four-part status check
- Read the grant or TIE against the actual authorised activity, not the marketing name of the course.
- Confirm whether the status is higher education and whether work is compatible with the timetable.
- Keep the weekly total within the applicable limit while study status continues.
- Change status before relying on a job-search residence or a later work route to permit employment.
The distinction begins earlier in the Spain student visa process. The visa application carries the application for the underlying study authorisation, and a stay over six months later requires a TIE. The National Police TIE procedure identifies the physical card as evidence of legal status, while NIE is the personal foreigner identity number.
Who qualifies for Spain’s job-search residence?
The route is for a person who held a long-stay study authorisation, completed higher education at an authorised Spanish institution, and reached at least European Qualifications Framework Level 6. That level corresponds to university degree level. It is not a general extension for every language course, short programme or unfinished qualification.
The applicant also needs qualifying health insurance and sufficient resources during the residence period. The official SEPE page publishes Spain’s current IPREM amounts, but the opened job-search source does not support one universal euro balance for every case on this page. Family composition and the applicable official assessment still matter.
| Test | Current national position | Common mistaken assumption |
|---|---|---|
| Prior status | Long-stay study authorisation | Any Schengen visit or short study is enough |
| Completed education | Higher education at an authorised Spanish institution, minimum EQF Level 6 | An incomplete course can be used |
| Purpose | Search for suitable employment or start a business project | The residence itself is a work permit |
| Duration | 24 months, non-renewable | The holder can extend it for another search period |
| Work | Not authorised during this residence | A job can start before the corresponding authorisation |
The Ministry states the no-work condition without qualification.
Durante la vigencia de la autorización de residencia para la búsqueda de empleo o para emprender un proyecto empresarial, no se está autorizado a trabajar.
Spanish Ministry of Inclusion, Hoja 20
The practical consequence is sharp. A graduate can interview, search and develop a qualifying business plan during the 24 months, but cannot treat a successful interview as permission to begin work. Once a suitable opportunity exists, the corresponding residence and work application becomes the next legal step.
How does a graduate apply for job-search residence?
The graduate files electronically through Mercurio during the 60 natural days before the study authorisation expires or within the 90 natural days after expiry. A filing in the later period can lead to sanction proceedings. These are statutory filing windows, not a recommendation to wait until the study status has ended.
- Confirm completion at minimum EQF Level 6 and obtain the institution’s completion evidence.
- Assemble valid identity, insurance and resource evidence for the residence period.
- Submit the application electronically through Mercurio inside the permitted window.
- Track the electronic procedure and preserve the filing acknowledgement.
- After a favourable outcome, apply for the TIE within one month of notification.
The Ministry publishes a 20-day decision period. If no express response arrives within that period, the application may be treated as granted through positive administrative silence. That legal effect is not the same as receiving a physical TIE or an employer-facing work authorisation. The graduate still needs the post-decision identity-card step, and the job-search status still doesn’t permit work.
The authorisation lasts 24 months and cannot be renewed. A graduate who finds neither qualifying employment nor a viable business transition cannot simply repeat the same residence. The route is best understood as a fixed search interval with a required status change before work begins.
How can a graduate change directly to employed work?
An eligible person can modify from a qualifying study or training authorisation after completing the corresponding qualification or certificate. The current route is handled from Spain and does not require a new entry visa. The application is electronic through Mercurio and must satisfy both the graduate-side and employer-side requirements in the Ministry’s April 2026 Hoja 58.
| Party | Evidence or condition | What the authority is testing |
|---|---|---|
| Graduate | Completed qualification or certificate under a qualifying prior authorisation | The study-to-work route is legally available |
| Graduate | Professional qualification where the occupation legally requires it | The person can perform the regulated activity |
| Employer and graduate | Signed contract with compliant conditions | The proposed employment is real and lawful |
| Employer | Tax and Social Security compliance | The employer meets public obligations |
| Employer | Means to meet the contract and maintain the activity | The role is financially supportable |
| After grant | Social Security registration | The employed authorisation becomes effective |
The published decision period is three months, and the initial modified authorisation lasts one year. Neither figure is an end-to-end promise about preparation, employer evidence or identity-card appointments. Once the authorisation becomes effective through the required Social Security registration, the holder applies for a new TIE within one month.
A role in a regulated profession may add a separate qualification-recognition question. Studying at one of Spain’s universities establishes the education completed, but it doesn’t automatically satisfy every professional access rule. The immigration modification and professional recognition should be checked as separate legal tests.
The direct route is most coherent when the evidence tells one consistent story. The completion document identifies the qualification obtained. The contract identifies the role, conditions and employer. Professional evidence answers any occupation-specific requirement. Employer records show compliance and capacity. If one element describes a different occupation, salary arrangement or employer from the others, the file no longer supports the same proposed employment.
How does self-employed work differ after study?
The direct self-employed route begins with the same broad transition idea but replaces the employment contract with evidence about the proposed activity. The applicant needs the qualification or experience required for the work, any licences or authorisations that apply, sufficient planned investment, and evidence that the activity can support the applicant.
Employed modification
- Signed employment contract
- Employer tax and Social Security compliance
- Employer capacity to meet the contract
- Social Security registration activates the grant
Self-employed modification
- Viable activity or business plan
- Required licences and professional standing
- Sufficient planned investment
- Evidence the activity can support the applicant
The Ministry’s Hoja 58 also gives the self-employed authorisation an initial one-year duration. It is not enough to call an idea a start-up. The evidence must connect the activity, the legal permissions, the applicant’s competence, the resources committed and the expected ability to sustain the work.
A graduate deciding between the two direct routes should use the actual work arrangement. A company role with an employer and contract belongs to the employed assessment. An independently operated activity belongs to self-employment. Reshaping the description to fit an easier-looking checklist can create inconsistencies across contracts, invoices, licences and Social Security records.
The timing choice also follows the evidence available. A graduate with a compliant signed offer can examine direct employed modification instead of first entering a non-working search period. A graduate who still needs time to find an opportunity may use job-search residence if eligible, while accepting its work prohibition. A developed independent project requires the business evidence of self-employment, not merely an intention to look for clients later.
When can a graduate work beyond 30 hours while a change is pending?
The Ministry student guide identifies a specific effect once a qualifying direct-modification application has been admitted for processing. The study stay, and the applicable family status, becomes provisional residence and work until the authority decides. This effect can permit work beyond the study route’s 30-hour weekly limit while that modification is pending.
La autorización de estancia y, en su caso, la de los familiares, adquirirá el carácter de autorización provisional de residencia y trabajo.
Spanish Ministry of Inclusion, Student guide
Admission for processing matters. Merely preparing or submitting a file is not safely described as the same procedural state without the official acknowledgement. The graduate should preserve the evidence that identifies the application and confirms its admission before relying on this provisional effect.
The provisional effect does not belong to job-search residence. A person on the 24-month search route remains expressly unauthorised to work until the corresponding employment or self-employment authorisation has been obtained. Mixing the two rules would turn a useful procedural protection into an unlawful early start.
What happens to a student’s family after graduation?
Family status follows the route selected by the principal holder. Family members already accompanying a graduate can remain for the same period under the job-search residence, but they are also not authorised to work. The search route therefore doesn’t solve an accompanying spouse’s employment question.
Under a qualifying direct modification, the Ministry’s procedure provides for the applicable family transition and the provisional residence and work effect described in the student guide once the modification is admitted for processing. The exact family application depends on the existing family status and the principal applicant’s route, so it should not be reduced to an automatic spouse work promise.
| Principal holder’s status | Family residence effect | Family work position |
|---|---|---|
| Higher-education study authorisation | Eligible accompanying family shares the student’s stay period and status | Study-family status does not authorise work |
| Job-search residence | Existing accompanying family can remain for the same search period | No work is authorised |
| Qualifying direct modification admitted | Applicable family status gains the provisional effect described by the Ministry | Read against the admitted modification and family procedure |
| Granted residence and work route | Family position follows the corresponding granted residence framework | Depends on the granted family authorisation, not the old student label |
A family should therefore plan around status dates, not only graduation day. The study authorisation’s expiry, the filing window, the principal route chosen and the family’s existing cards all affect what follows. One household may need a non-working search period, while another may be able to move through a direct modification supported by a compliant job or business case.
- Higher-education study status can permit compatible employed or self-employed work, normally up to 30 hours weekly.
- Spain’s job-search residence lasts 24 months and is non-renewable, but it expressly prohibits work throughout that status.
- Job-search filing opens 60 natural days before study-authorisation expiry and continues for 90 natural days after, with possible sanction for late filing.
- A qualifying graduate can seek direct modification to employed or self-employed residence and work without a new entry visa.
- Once a qualifying direct modification is admitted for processing, provisional residence and work can permit work beyond the study limit while the decision is pending.
- Family on study or job-search status cannot assume work permission. Their position follows the principal holder’s selected route and granted status.
Frequently asked questions
Can international students work in Spain?
A higher-education study authorisation automatically permits compatible employed and self-employed activity, normally up to 30 hours each week. That statement does not cover every language, training or secondary-study route. The authorised activity shown in the student’s legal status, compatibility with studies and any profession-specific requirement all remain important.
Does Spain have a post-study work visa?
Spain has distinct post-study routes, not one status that always permits work. Its 24-month job-search residence allows an eligible graduate to remain but prohibits work. A direct modification into employed or self-employed residence and work is the route that creates work permission when its qualification, contract or business conditions are met.
How long is Spain’s job-search residence?
The current national route lasts 24 months and cannot be renewed. The graduate may search for suitable employment or prepare a business project during that period, but cannot work on the residence itself. A corresponding work authorisation is required before beginning the employed role or self-employed activity found during the search.
When can a graduate apply for job-search residence?
Electronic filing through Mercurio is permitted during the 60 natural days before the study authorisation expires and the 90 natural days after expiry. An application in the later period can lead to sanction proceedings. Completion at minimum EQF Level 6, insurance and sufficient resources remain separate eligibility requirements.
Can a graduate work while job-search residence is pending?
The job-search route should not be treated as work permission, whether the application is pending or granted. The Ministry expressly prohibits work during the granted 24-month residence. The separate provisional residence and work effect applies when a qualifying direct modification is admitted for processing, not when a job-search application is filed.
Is three years of study required to change to work status?
The current Ministry modification sheet updated in April 2026 does not impose the old generic three-year study condition. A graduate still has to hold a qualifying prior authorisation, complete the corresponding qualification or certificate, and satisfy the employed or self-employed route. Older web summaries can therefore produce the wrong eligibility test.
Can the family of a graduate work in Spain?
Study-family status does not authorise work, and family members accompanying a graduate on job-search residence also cannot work. A later family position depends on the principal holder’s direct modification or granted residence framework and the authorisation issued to the relative. Graduation by itself does not convert family status into work permission.
